Ugandan lawyer sues President Ruto over his decision to recall the EAC secretary general

Hassan Mabirizi a Ugandan lawyer has issued a complaint to the East African court of justice (EACJ), challenging president William Ruto’s decision of recalling Dr. Peter Mathuki  the secretary general of the east African community for a state job .

The Ugandan lawyer termed the act to be unlawful, since Dr. Mathuki’s five year time is not yet over. He wants the court to prevent the Kenyan government from removing Dr. Mathuki until his period is over.

“Your applicant prays that the court issues a permanent injunction restraining Kenya from furtherance with the implementation of the March 8 action and decision by president Ruto to replace Mathuki,” the lawyer stated

According to the lawyer, president Ruto’s decision is in contravention of the EAC treaty which states that the secretary general shall serve a fixed five year term.  He argued that Kenya has disregarded the Rule of Law and Equal Opportunities Doctrine, fundamental principles of the EAC, as well as Article 7(2) of the EAC Treaty, which designates the rule of law as an operational principle of the community.

Dr.Mathuki was appointed as ambassador to Russia by president Ruto on March 8, 2024.
