The Employment and Labour Relations Court lifts suspension orders issued to Bomas of Kenya CEO

Employment and labour relations court has redirected the Bomas of Kenya board to lift the suspension of its CEO Peter Gitaa Koria.

Gitaa was suspended for 12 months following recommendations of the Ethics and Anti-Corruption Commission (EACC) but the court has ordered that the CEO to return to work, pending the hearing and determination of the petition.

"Considering that no criminal charges have yet been brought against the applicant in terms of section 62 of AECA, 2023 by the 2nd respondent; and keeping in mind that the suspension occurred on 20th November 2023 about five (5) months from the date of this ruling; the applicant has satisfied the threshold required for grant of the interim injunction," the court ruled 

Justice Nduma Nderi made the ruling asserting that the court has not found disciplinary provisions applicable to the CEO in the Bomas of Kenya human resource policies and regulations, revised 2016.

On the other hand the EACC was not impressed with the ruling and is set to appeal against it.

BoK CEO is among six other CEOs who were recommended for suspension by the EACC over allegations of corruption and procurement flaws in their sectors.
