High court rules the KRA recruitment of service assistants unconstitutional

High court justice William Musyoka has interdicted the Kenya revenue authority (KRA) from recruiting staff until an ethnic diversity and regional balance policy is established in 30 days.

The high court on Monday ruled that KRA’s recent recruitment of 1,406 revenue service assistants was unconstitutional.

According to Justice William Musyoka, the government agency violates the law of diversity, inclusion and regional balance as a huge percentage of the advertised slots were allocated to two communities.

The ruling places the Kenya Revenue Authority in an unstable operational situation due to its role in revenue collection and economic stability. However, the KRA have not responded to the ruling yet.

The judiciary’s decision serves as a nudge to other government institutions to ensure they comply with the legal standards regarding diversity, equality and regional balance.
