Justice Olga Sewe has affirmed that the court order suspending the intended Annual General Meeting by the Football Kenya Federation is still effective.
Justice Sewe suspended the AGM pending hearing of a substantive application filed by the FKF National Executive Committee (NEC) member Gabriel Mghendi.
The NEC member is questioning the directions and orders of the Sports Dispute Tribunal over alleged contempt.
The Annual General Meeting was meant to pave way for FKF elections to make amends on the controversial 2020 FKF electoral code and electoral board.
The FKF on the other hand has disregarded Nyakundi’s involvement of the court terming it as an abuse of the court and that the has no jurisdiction to hear the case.
Earlier on the world football governing body FIFA had threatened to strip off FKFs exercise rights due to the suspension.
“FIFA takes the view that any further attempt by a third party to prevent the FKF Annual General Meeting from taking place might be considered a violation to the above-mentioned principle, which would oblige our institution to bring the matter to the attention of the relevant FIFA bodies for consideration of possible sanctions in line with the FIFA Statutes,” FIFA stated
The FKF annual general meeting was to happen on 16th of March 2024 but an order from the Mombasa high court temporarily stopped it
