Court halts planned strike by medical practitioners

Court stops potential doctor’s strike for negotiations over provision of essential services when the strike happens

The employment and labour relations court has ordered the Kenya Medical Practitioners, Pharmacists and Dentist Union (KMPDU) to stop their planned seven day strike that was to happen from Thursday, March 14, 2024.

According to Justice Byram Onganya, the order was made to provide favorable environment for negotiations and agreements on essential services to continue when the strike takes effect.

“Pending the return date or further orders by the court and pending the determination and filing of the agreement on the minimum safety services mentioned in order 2 above, there shall be stay of the taking effect of the strike notice and going on strike of the union’s members as notified in the strike notice,” the order stated.

The Kenya medical practitioners, pharmacist and dentists union issued a notice to the state on March 6 over a seven day strike, saying the issues affecting health care workers have not been addressed in the country.

The court has directed the cabinet secretary for the ministry of labour and social services to call for a tripartite meeting by Thursday noon.

The court order was issued following a certificate of urgency filed by James Kounah and supported by an affidavit from Jane Akunda on 12th march 2024.
